1. Acceptance of Terms

By using the Bmaria Tech website or services (the “Platform”), you agree to these Terms of Use (“Terms”) and all applicable laws. Bmaria Tech operates as a direct-to-customer online store selling authentic UK gadgets to Nigerian customers.

These Terms govern all users of the Platform. You must be at least 18 years old to create an account and use our services. By registering an account, placing orders, or using the Platform, you accept and consent to these Terms and any updates we post. If you do not agree with these Terms, you must stop using the Platform immediately.

We may amend these Terms at any time by posting the revised Terms on the Platform. Your continued use after changes are posted constitutes acceptance of those changes. Please review the most current Terms whenever you access the Platform.

2. Accounts and Eligibility

  • Account Creation: To make purchases, you must create an account with accurate, complete, and up-to-date information (name, email, phone number, delivery address) and set a secure password. You are responsible for all activity under your account.
  • Age and Authority: You must be 18 or older to hold an account. If under 18, a parent or guardian must create the account on your behalf. By creating an account, you confirm you have full legal capacity to do so. Bmaria Tech may verify your age or identity at any time.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials. Notify Bmaria Tech immediately of unauthorized access. We are not liable for any loss resulting from unauthorized use of your account.
  • Termination of Account: You may close your account by contacting customer support. Bmaria Tech may suspend or terminate your account for violations of these Terms or applicable law. Upon termination, access to account-only features ends, and your personal information may be deleted or anonymized.

3. Product Sales and Fulfillment

  • Bmaria Tech sells authentic new and used gadgets directly to customers in Nigeria.
  • All products are purchased in the UK, inspected, and shipped through our Lagos office or designated pickup locations across Nigeria.
  • Order Processing: Orders are processed after payment confirmation. We reserve the right to verify stock availability before shipment.
  • Delivery: Shipping and delivery are managed by Bmaria Tech and our logistics partners. Delivery times may vary based on location and logistics circumstances.
  • Returns & Exchanges: Products may be returned or exchanged according to our Return Policy. Only eligible items returned in original condition will be accepted.

4. Paid Features and Services

  • Bmaria Tech may offer optional paid services, such as priority shipping or promotional offers. These are one-time charges and generally non-refundable unless required by law.
  • Fees are exclusive of applicable taxes, which may be added according to Nigerian tax regulations.
  • No subscription is required for standard purchases. All basic services are free for users.

5. User-Generated Conten

  • Users may submit reviews, comments, or feedback (“User Content”). You retain ownership of your content but grant Bmaria Tech a worldwide, royalty-free license to use, display, reproduce, or distribute it in connection with the Platform.
  • You are responsible for all content you submit. Content must comply with applicable laws and not violate third-party rights.
  • Bmaria Tech may review, moderate, or remove User Content at its discretion. We are not responsible for the accuracy or reliability of user-submitted content.

  • No Professional Advice: All content on the Platform is for general information only and does not constitute professional advice.
  • “As Is” Basis: The Platform and all services are provided “as is” and “as available.” Bmaria Tech disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
  • Third-Party Services: Links to third-party websites are provided for convenience. Bmaria Tech does not endorse or control these sites and is not responsible for their content or services.
  • Data and Technology: While we take security measures, we cannot guarantee absolute privacy or protection against hacking or data interception.

7. Limitation of Liability

  • No Indirect or Consequential Damages: Bmaria Tech is not liable for special, incidental, indirect, or consequential damages, including loss of revenue, profits, or data, arising from your use of the Platform.
  • Limited Direct Liability: Our total liability shall not exceed the total amount paid by you for products in the 12 months preceding a claim. We are not liable for:
    • Unauthorized account use if you fail to notify us.
    • Losses from reliance on user-submitted content.
    • Issues related to third-party logistics or services.

8. Indemnification

You agree to defend, indemnify, and hold harmless Bmaria Tech and its affiliates, officers, and employees from claims, liabilities, damages, losses, or expenses arising from your violation of these Terms, misuse of the Platform, or breach of third-party rights.

9. Termination and Suspension

  • By Bmaria Tech: Accounts may be suspended or terminated for violations of these Terms or applicable law.
  • By User: You may close your account at any time by notifying customer support.
  • Effect of Termination: Termination does not release you from prior obligations. Licenses for User Content terminate upon removal, but published content may remain.

10. Changes to the Terms of Use

Bmaria Tech may revise these Terms at any time. Updated Terms are effective when posted. Continued use constitutes acceptance of changes.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria. You agree to submit to the exclusive jurisdiction of Nigerian courts for disputes arising from these Terms or the Platform.

12. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and Return Policy, constitute the full agreement.
  • No Waiver: Failure to enforce any right does not waive it.
  • Assignment: You may not assign rights without our consent; Bmaria Tech may assign rights freely.
  • Notices: Notices may be delivered via email or the Platform.
  • Translation: The English version governs in case of translation.
